Holiday Gift Cards: Know Your Rights and What to Do With Unwanted Ones

January 5, 2026 –As the holiday season wraps up, gift cards remain one of the most common presents exchanged, but they often go unused. Illinois consumers should know that state law offers strong protections when it comes to gift cards, giving recipients time and flexibility to use them or turn them into something more useful. In Illinois, most store-specific gift cards may not expire for at least five years from the date they are issued, and retailers are generally prohibited from charging post-purchase fees that reduce a card’s value. These protections apply primarily to cards issued by a single retailer for use at its own locations. 

Some exceptions do apply. Gift cards that can be used at multiple merchants, such as certain mall cards or bank-issued cards, are often governed by federal law, which also requires a minimum five-year expiration period but may allow certain fees if they are clearly disclosed. Promotional or loyalty cards issued as part of a special offer may also follow different rules. Consumers are encouraged to read the terms printed on the card or provided by the issuer to understand any limitations. 

For those who receive gift cards they do not plan to use, there are several ways to avoid letting them go to waste. Cards can be sold through online resale platforms or local marketplaces, though sellers should expect to receive less than the card’s full value and take steps to avoid scams. Another option is trading cards with friends or family members who may shop at that retailer. Some charities also accept gift cards as donations, which can benefit local organizations while putting unused funds to good use. In some cases, retailers may allow customers to combine balances from multiple cards into one, making them easier to use. 

With Illinois laws offering strong consumer protections, gift cards are far less likely to lose value over time. Still, using them promptly, understanding the rules that apply, and exploring options for resale or donation can help ensure holiday gift cards provide real value long after the season ends.
