Decatur City Council Approves Mask Fines

November 17, 2020 –The Decatur City Council took the step to approve fines for not wearing a face covering. 

The ordinance applies to individuals and businessesAn amendment was made to the ordinance reducing the fines for individuals by half.   

Fines for individuals initially were set for 50 dollars for the first offense, 100 for the second offense, 200 for the third offense and 500 for the fourth and each subsequent offense.  Businesses would be fined $250 for the first offense and $500 for subsequent offenses. 

Now fines will range from $25 to $250 for individuals.

The vote passed 5-2 with Councilman Rodney Walker and Councilman Bill Fabor voting no.  

Councilwoman Lisa Gregory admitted that she originally believed residents would do the right thing when she requested a mask ordinance be pulled from the agenda earlier this year.  It is clear now that far too many of our citizens are not doing the right thing and have become completely obstinate.   

“I’m tired of hearing about freedoms.  People doing the right thing and wearing a mask have a right to stay healthy” said Councilman Pat McDaniel. Though McDaniel approved the mask measure, he also polled the council on the possibility of allowing restaurants to offer indoor dining in violation of the state mandateMcDaniel offered an amendment to the current ordinance to allow this, however, the amendment was turned down 

Councilman Rodney Walker advocated for waiting on a mask mandate until December 31st to see if the positivity rate would go down. 

Councilman Faber said he fully respects those that believe this is an infringement on their freedoms. “However, this is not a constitutional issue.  The constitution allows courts and government officials to issue a regulation that enhances and protects the welfare of a community.”  Still, Faber voted against the measure saying he believes the Decatur community will do the right thing. “I don’t want to anger and further divide the community.”  

Councilman David Horn remained firm in his support of the mask fines and mandate “Protecting the health and safety of our residents is our number one responsibility. With this rise in COVID cases, tt is clear that further action is needed by the council.  It is clear an ordinance is LONG overdue. Individuals who do not wear a mask are unnecessarily risking people’s lives and the businesses they are frequenting” said Horn.
